RESCUEBASE Oy ("Controller") respects your privacy and is committed to safeguard the privacy of those persons ("User") using "Controller's" online service "Hoetuu", available from Apple's 'App Store' ("Service"). This Privacy Policy provides "Users" information on how the "Controller" processes their personal data and how the "Controller" protects the same. Personal data refers to personally identifiable information, such as name, address, phone number and email address. We encourage the "User" to read this document before using the "Service". If you do not agree with the terms, do not access or use the "Service" or any other aspect of "Controller's" business.
Personal data may be processed for the purposes of using, maintaining and developing the "Service". The "Controller" commits to adhere to the provisions of the Personal Data Act and other such applicable laws and regulations pertaining to the processing of personal data, as well as process personal data in compliance with good processing practice. The "Controller" will pursue to take appropriate measures in order to prevent unauthorized access to personal data, any inappropriate use thereof and any possible inaccuracies. All personnel processing personal data are obliged to keep such information strictly confidential.

In exceptional circumstances personal data may be disclosed to third parties if required under any applicable law or regulations or order by competent authorities, or in order to enforce the terms of service and to investigate possible infringing use of the "Service" as well as to guarantee the safety of the "Service". The "Controller" may use external service providers to provide technical solutions for processing stored data and access the stored data by using a technical interface.
The register will be maintained in external service providers' servers with appropriate safeguards, such as password protection, granting the access to the stored information only to the "Controller". The register is protected by appropriate industry standard, technical and organisational safety measures. The database will be accessible only to those persons expressly authorized by the "Controller"
A "User" is entitled to review any information collected on him/her and stored in the register once per year free of charge. When a "User" wishes to use the above right to review stored information, the "User" should send a signed request thereof to the "Controller" using the contact details below. A "User" may also review any information collected on him/her and stored in the register independently by using a technical interface, username and password, and update and modify the stored personal data.
The "Controller" may change this Privacy Policy from time to time, and in the "Controller's" sole discretion. All changes hereto will be made available on this page, which is why the "Controller" encourages "Users" to frequently check this page for any changes to its Privacy Policy. Changes hereto will not prejudice "Users'" rights without their consent. The "Controller" will NOT inform the "Users" of material changes. If you disagree with the changes to this Privacy Policy, you should delete your "Service" account.
To the extent prohibited by applicable law, "Controller" does not allow the use of our "Service" by anyone younger than 18 years old. If you learn that anyone younger than 18 has unlawfully provided us with personal data, please contact us and we will take steps to delete such information.

[BY CREATING AN USER ACCOUNT AS PART OF THE REGISTRATION PROCESS], YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS GOVERNING YOUR USE OF RESCUEBASE OY'S ONLINE SERVICE “HOETUU” DESIGNED TO "GET S...STUFF DONE", AVAILABLE AS A MOBILE APPLICATION (“SERVICE”). AS USED IN THESE TERMS OF USE, THE TERM "YOU" OR “USER” REFERS TO THE PERSON USING THE SERVICE IN ANY WAY AS A USER. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY.
Subject to the terms and conditions of these Terms of Use, RESCUEBASE Oy ("HOETUU") provides a mobile based service that allows you to create a user-specific account (a "User Account") to interact with the Service. Your registration for, or use of, the Service shall be deemed to be your agreement to abide by this Agreement including any materials available on the RESCUEBASE'S website incorporated by reference herein, including but not limited to RESCUEBASE's privacy and security policies.
Subject to the terms, conditions and restrictions in these Terms of Use, RESCUEBASE grants to you, a limited, non-exclusive, non-transferable and non-sublicensable right to use the Service as set forth in these Terms of Use (“License”).
You are responsible for all activity occurring under your User Account and will abide by all applicable laws and regulations in connection with your use of the Service, including those related to data privacy, international communications and the transmission of technical or personal data. You will: (i) notify RESCUEBASE immediately of any unauthorised use of any password or User ID or any other known or suspected breach of security; (ii) report to RESCUEBASE immediately and use reasonable efforts to stop immediately any copying or distribution of the Service that is known or suspected by you; and (iii) not impersonate another RESCUEBASE user or provide false identity information to gain access to or use the Service. The User shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or the right to use any of the data and materials incorporated into the Service. RESCUEBASE shall be permitted to access such property, data (including personal data) and materials (“Data”) for providing the Service (including profiling) according to the terms and conditions described in these Terms of Use.
You shall not (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Service; (ii) modify or make derivative works based upon the Service; (iii) create Internet "links" to the Service or "frame" or "mirror" any content on any other server or wireless or internet-based device; or (iv) reverse engineer or access the Service in order to (a) build a competitive product or service, (b) build a product using similar ideas, features, functions or graphics of the Service, or (c) copy any ideas, features, functions or graphics of the Service. You may use the Service only for internal business purposes and will not: (i) send spam or otherwise duplicative or unsolicited messages in violation of applicable laws; (ii) send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortuous material, (iii) send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs; (iv) interfere with or disrupt the integrity or performance of the Service or the data contained therein; or (v) attempt to gain unauthorised access to the Service or its related systems or networks.
During the Term of this Agreement, in the event that RESCUEBASE discovers that User Account is causing any problems with the Service or the server that the Service is hosted on, RESCUEBASE may, with your permission which will not be unreasonably withheld, access or copy User Account to an account controlled by RESCUEBASE so that RESCUEBASE may investigate the User Account and the problems that it may be causing. In the event, upon RESCUEBASE's investigation, RESCUEBASE discovers any significant problem(s) with the User Account, RESCUEBASE may take it offline without your prior notice or permission, until the problem is cured to the satisfaction of RESCUEBASE.
This Agreement confers only the right to use the Service, while this Agreement and the specified license(s) are in effect and it does not convey any rights of ownership in or to the Service. All right, title and interest, including without limitation any copyright, patent, trade secret or other intellectual property right in the Service will remain the sole property of RESCUEBASE. Any services provided to you under this Agreement, including methods, processes, notes, designs, code, documentation, memoranda, and other data or materials that are prepared in the performance of such services hereunder, and all right, title and interest in the foregoing, will belong to RESCUEBASE.
Some parts of the Service may be offered for a fee and use of such services is subject to payment of the relevant service fees and other possible charges. Use of the Service is priced in the App Store and Google Play. RESCUEBASE shall have the right to prevent use of the Service or a part thereof in the event that the User has failed to make payments when they become due and has not paid such payments within two weeks time after having been sent a notification thereof. RESCUEBASE shall have the right to charge reasonable compensation for re-opening the Service.
This Agreement commences on the Effective Date and the term is indefinite and may be terminated at any time in RESCUEBASE's / Users's sole discretion with one (1) month notice. RESCUEBASE, in its sole discretion, may terminate your account or use of the Service with immediate effect if you materially breach or otherwise fail to comply with these Terms of Use. You agree and acknowledge that RESCUEBASE has no obligation to retain the Data, if you have materially breached this Agreement.
The User represents that it has: (i) the legal power and authority to enter into this Agreement; and (ii) not previously entered into any agreement or understanding which conflicts with any rights or obligations set forth in this Agreement. You represent and warrant that all information provided by you in connection with your registration is accurate and reliable, that you have not falsely identified yourself nor provided any false information to gain access to the Service and that your use of the RESCUEBASE Services do not directly or indirectly infringe the legal rights of a third party. RESCUEBASE AND ITS LICENSORS MAKE NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE OR ANY CONTENT. RESCUEBASE AND ITS LICENSORS DO NOT REPRESENT OR WARRANT THAT: (I) THE USE OF THE SERVICE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA; (II) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR RESULT IN REVENUES OR PROFITS; (III) ANY STORED DATA WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (V) ERRORS OR DEFECTS WILL BE CORRECTED; OR (VI) THE SERVICE OR THE SERVER(S) THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SERVICE AND ALL CONTENT IS PROVIDED TO YOU STRICTLY ON AN "AS IS" BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY RESCUEBASE OR ITS LICENSORS
You will indemnify and hold RESCUEBASE, its licensors and each such party's parent organizations, subsidiaries, affiliates, officers, directors, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (i) a claim alleging that Your Web Service infringes the rights of, or has caused harm to, a third party; (ii) a claim, which if true, would constitute a violation by you of your representations and warranties; or (iii) a claim arising from the breach by you, provided in any such case that RESCUEBASE: (a) gives written notice of the claim promptly to you; (b) gives you sole control of the defense and settlement of the claim (provided that you may not settle or defend any claim unless you unconditionally release RESCUEBASE of all liability and such settlement does not affect RESCUEBASE's business or the Service); (c) provides to you all available information and assistance; and (d) has not compromised or settled such claim.
IN NO EVENT SHALL RESCUEBASE'S LIABILITY EXCEED THE AMOUNTS ACTUALLY PAID BY AND/OR DUE FROM YOU IN THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM. YOU EXPRESSLY UNDERSTAND AND AGREE THAT RESCUEBASE AND ITS LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF RESCUEBASE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICE RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICE PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE. YOU ALSO AGREE THAT RESCUEBASE WILL NOT BE LIABLE FOR ANY (A) INTERRUPTION OF BUSINESS, (B) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THIS SITE OR THE WEB SITE(S) YOUR ACCESS THROUGH THE SERVICE; (C) DATA NON-DELIVERY, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (D) UNAUTHORIZED ACCESS TO DATA ENTERED IN, OR BREACH OF ANY SECURITY MECHANISMS UTILIZED IN, THE SERVICE OR IN ANY RESTRICTED FIELD THEREIN; OR (E) EVENTS BEYOND RESCUEBASE'S REASONABLE CONTROL. YOU SPECIFICALLY ACKNOWLEDGE THAT RESCUEBASE SHALL NOT BE LIABLE FOR USER'S OWN CONTENTS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY USING YOUR WEB SERVICES AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU. RESCUEBASE'S SERVICES MAY BE SUBJECT TO LIMITATIONS, DELAYS, AND OTHER PROBLEMS INHERENT IN THE USE OF THE INTERNET AND ELECTRONIC COMMUNICATIONS. RESCUEBASE IS NOT RESPONSIBLE FOR ANY DELAYS, DELIVERY FAILURES, OR OTHER DAMAGE RESULTING FROM SUCH PROBLEMS.
RESCUEBASE reserves the right at any time and from time to time to modify the Service (or any part thereof) with or without notice. Should RESCUEBASE choose to permanently discontinue the Service, RESCUEBASE: (i) will post notification of this decision on the RESCUEBASE web site at least thirty (30) days prior to such discontinuance. In such instance, you will be responsible for retrieving your data from the Service during that sixty (60) day period. You agree that RESCUEBASE will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service, or for any resulting loss or destruction of Your Web Services that you place on the Service. RESCUEBASE may specify from time to time the version(s) of related products required in order to use the Service (e.g. supported browser versions).
RESCUEBASE may periodically change the terms of this Agreement. In the event RESCUEBASE modifies this Agreement, RESCUEBASE will post it to the RESCUEBASE web site. Your continued use of any of the Service after such modification will constitute your acceptance of this Agreement with the new modifications. If you do not agree to any of such changes, you may terminate this Agreement and immediately cease all access and use of the Service. You agree that such termination will be your exclusive remedy if you do not wish to abide by any changes to this Agreement. In addition, RESCUEBASE may at any time introduce separate Agreements for users in certain jurisdictions and require users in these jurisdictions to agree to the separate Agreements. RESCUEBASE may also require such users to agree that termination of the separate Agreements and cessation of all access and use of the Service would be their exclusive remedy if they do not wish to comply with the separate Agreement.
The Service is controlled and offered by RESCUEBASE from its facilities in Finland. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law. You agree that: (i) the Service shall be based in Finland or any other location that RESCUEBASE will decide to have them be based in; and (ii) the Service shall be deemed a passive Service that does not give rise to personal jurisdiction over RESCUEBASE, either specific or general, in jurisdictions other than Finland. These Terms of Use, together with the Privacy Policy (in this document) and any other legal notices published by RESCUEBASE on the Service, shall constitute the entire agreement between you and RESCUEBASE concerning the Services. If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of use, which shall remain in full force and effect. No waiver of any term of this these Terms of use shall be deemed a further or continuing waiver of such term or any other term, and RESCUEBASE's failure to assert any right or provision under these Terms of use shall not constitute a waiver of such right or provision. RESCUEBASE reserves the right to amend these Terms of use at any time and without notice, and it is your responsibility to review these Terms of use for any changes. Your use of the RESCUEBASE Services following any amendment of these Terms of use will signify your assent to and acceptance of its revised terms.
RESCUEBASE may give notice by means of a general notice on the RESCUEBASE website. Such notice will be deemed to have been given upon the expiration of 48 hours after posting on the website and 24 hours after sending by email. You may give notice to RESCUEBASE at any time by any of the following: email to contact(-)rescuebase.net or by letter delivered by nationally recognized overnight delivery service or first class postage prepaid mail to RESCUEBASE's addresses on its website.
This Agreement may not be assigned by you without the prior written approval of RESCUEBASE but may be assigned by RESCUEBASE to (i) a parent or subsidiary, (ii) an acquirer of assets, or (iii) a successor by merger. Any purported assignment in violation of this section will be void.
In the event that any provision of this Agreement is found invalid or unenforceable, it will be enforced to the extent permissible and the remainder of this Agreement will remain in full force and effect.
This Agreement constitutes the complete agreement between the parties with respect to its subject matter and supersedes all prior or contemporaneous discussions, representations, and proposals, written or oral, with respect to the subject matters discussed herein. No modification of this Agreement will be effective unless contained in writing and signed by an authorized representative of each party. Notwithstanding applicable law, electronic communications will not be deemed signed writings.
The failure of a party to prosecute its rights with respect to a breach hereunder will not constitute a waiver of the right to enforce its rights with respect to the same or any other breach.
This Agreement and the relationship between RESCUEBASE and the User shall be construed, governed and enforced in accordance with the laws of Finland without giving effect to its choice of law provisions. All disputes arising out of or in connection with this Agreement and with the relationship between RESCUEBASE and the Company shall be submitted to the exclusive jurisdiction of the Pirkanmaa District Court, Finland.
